Are You the Victim of Wrongful Termination? What Can Be Done?

If you feel that you have been wrongfully terminated from your job, you do have some rights.  Your first step will be to find out if you fall under wrongful termination.  Actually, there is no "wrongful termination" law as such.  Instead, there are many different federal and state laws that deal with this subject.

 

One way that you can qualify for wrongful termination is if you were fired because of discrimination.  This might be due to your race, your sex or even your religious (or nonreligious) views.  It might be because of a disability or any number of other factors.  If you can prove that you were let go because of discrimination, you can claim wrongful termination.

 

If you were fired in retaliation for reporting an employer’s illegal activity, you have grounds for a wrongful termination lawsuit.  You cannot be fired on these grounds at all.  In addition, they cannot fire you for refusing to do something illegal, or for a legal action that you took.  These all fall under wrongful termination.

 

If your employer can be caught for a breach of explicit or implied contract, you also have grounds for a wrongful termination suit against the company.  This is a bit sticky, as most people do not work under contract.  However, if you are satisfying the terms of your contract, then you generally cannot be let go and it is considered wrongful termination if it does happen.
