Are Taxes Necessary for Non Resident Aliens?

If you are a nonresident alien, such as a student working in America on a Visa, taxes can be complicated.  Do you need to file, or is this something that can be overlooked?  Tax laws are certainly different for aliens, but the bottom line is that if you make more than the personal exemption allowed by law, you do have to file a tax return.

Tax laws require that all aliens file paperwork for their taxes.  A form 1040NR or a form 1040NR-EZ is required if you have made money beyond the personal exemption.  However, even if you are exempt from filing taxes for financial reasons, you will still need to fill out form 8843 for exempt individuals and individuals with a medical condition.

If you fail to file taxes as a nonresident alien, your Visa status could be in jeopardy.  Visa laws require you to comply with all United States laws, including tax laws.  If you do not owe taxes, you will find that the IRS will not impose a financial penalty for failure to file, but you also may miss any refund that could be due to you.  Filing your taxes is essential and may well help you recover more of your wages if you have paid more than you should.

Nonresident aliens have to file their taxes every year.  Whether you owe, are owed, or have no taxes at all, there is a form that you are required to send to the IRS every fiscal year.
